Terms of service

The agreement between your business and us for using Waving.

These are the terms while Waving is in early access. They are short because the service is free and small. They will grow when it is not.

Early access

Waving is free during early access. There is no card and no trial clock. It will become a paid product, and if you are an early adopter you will hear about pricing before anyone else, with time to decide. We may change or withdraw features while we learn, and we will tell you before anything you rely on goes away.

Your account

One account per business. You are responsible for everything sent from it, including by anybody you give access to. Keep your sign-in details safe and tell us at once if you think someone else has them.

You must be at least 18 and using Waving for a business, not personally.

What you send

You are the sender of every email. You are responsible for the content, for who receives it, and for having a lawful basis to contact them. Our acceptable use policy sets out what that means and is part of these terms. Breaking it can end your account.

Nothing sends until you have approved it. That is a feature, and it also means you have read everything that goes out under your name.

Your domains

You may only connect domains you own or control. You add the DNS records we ask for, and we set up the sending identity behind them. If a domain’s records stop passing, sending from it stops until they pass again. When you leave, we remove the identity.

Your data

Your leads, your emails and your replies are yours. You give us permission to process them to provide the service and for nothing else. We do not use them to train anything, share them with other customers, or sell them. Our privacy policy says what we hold, where, and for how long.

You can export everything at any time. When your account closes we delete your database within 30 days, keeping only the suppression list so that people who said no stay unsent.

Availability

We try to keep Waving running all the time and we keep 30 days of backups. During early access we do not promise any particular uptime, and sending can be paused for deliverability reasons at any time, as the acceptable use policy explains. We will tell you when something is wrong and when it is fixed.

Liability

Waving is provided as it is. While it is free, our liability to you for anything arising from it is limited to what the law does not let us exclude. We are not liable for lost business, lost replies or anything that follows from an email you chose to send. Nothing here limits liability for fraud or for death or injury caused by negligence.

Ending this

You can close your account whenever you like from the app or by emailing us. We can close it if you break these terms or the acceptable use policy, or if we stop the service, in which case we will give you as much notice as we can and time to export your data.

The law

These terms are governed by the law of England and Wales and any dispute goes to its courts.
